ENKI ART — Terms of UseClosed Beta

Enki is currently in closed beta. Access is limited and invite-based while the platform is being developed and tested with a small group. Features and listings may still change as the platform evolves. By using Enki during the closed beta, you agree to the terms below.
1. What Enki is
Enki is a marketplace where artists list encrypted prompts. Buyers pay per use to generate an image and receive the output only — never the underlying prompt, workflow, or settings.
Enki is operated as an independent project by Kevin Germin, based in Braunschweig, Germany. There is no company behind it yet; it is run by an individual. Questions: kgermin@tuta.io.
2. Closed beta — no guarantees
During the closed beta, Enki is provided “as is” and “as available.” As the platform is still in active development, there is no guarantee of uptime, availability, accuracy, results, or data retention, and features, listings, balances, or accounts may change as the beta progresses. Please don’t rely on Enki for anything critical during this phase.
3. Your wallet, your funds
Enki is non-custodial. You control your own wallet and keys. Enki never takes custody of your tokens and cannot move your funds. Blockchain transactions are final and irreversible — they cannot be reversed, refunded, or charged back. You are solely responsible for securing your wallet; lost keys or access cannot be recovered by us.
4. What you pay
The price shown is the price charged. Prices are quoted in USD and settled in USDC. Nothing is added at checkout.
You pay only for a delivered image. Starting a generation authorizes the payment — it does not make it. No funds move until the image has actually been produced and stored. If the generation fails, is cancelled, or is refused under Section 6, the authorization is cancelled and nothing is charged at all. There is no refund to wait for, because no payment was ever made.
Network fees. Each generation payment includes a flat network fee (currently $0.005) covering the blockchain transaction costs. It is part of the total shown before you confirm the order — nothing is added beyond the displayed price, and you still need no SOL in your wallet, only USDC. The separate one time setup cost for an artist payout account is described in Section 7.
5. AI-generated content
All images produced through Enki are generated by AI and are marked as such. Outputs are created by a third-party AI model, and your use of them is subject to that model provider’s terms and to applicable law. Enki makes no promise that an output is original, unique, or protectable, and claims no ownership of outputs.
6. Prohibited use — read this one
You must not use Enki to generate, request, or list prompts intended to produce:
- Sexual content involving minors, or any content that sexualizes minors, in any form;
- Non-consensual intimate imagery, or realistic depictions of real, identifiable people without their consent (including deepfakes);
- Content that is illegal, infringes someone’s intellectual property or likeness rights, or facilitates fraud, harassment, or serious harm.
We may remove any prompt, output, or account, and refuse service, at any time — especially for anything in this section. To report something, contact kgermin@tuta.io.
7. Prompts belong to the artists
Prompts are the confidential property and trade secrets of the artists who list them. Buying a generation does not grant access to the prompt, and gives no exclusive rights — others may generate similar images from the same or similar prompts. Artists may remove a prompt at any time; images already generated remain usable by the buyer who made them.
Artist payouts. Artist shares are paid directly on chain to the artist’s own wallet with every generation — Enki never holds artist funds. A one time network setup cost for the payout account (currently about $0.15; it varies with network conditions) is deducted in halves from an artist’s first revenue shares until covered. On prompts added through a referral, half of Enki’s platform fee on each generation is shared between the referrer and the artist (one quarter each); Enki keeps the other half.
Referred artists. If a prompt is added before its original artist has joined Enki, the artist share of each sale accrues as a promotional signing bonus offer from Enki. This is a conditional marketing offer, not funds held or safeguarded on the artist’s behalf. Claiming the profile pays the accrued bonus (minus the network setup cost) to the artist’s new wallet; from then on all future shares flow directly. Offers expire 12 months after the first accrual.
8. Limitation of liability
To the fullest extent permitted by law, Enki and its creator are not liable for any indirect, incidental, or consequential loss arising from use of the platform. Nothing here excludes liability that cannot legally be excluded (such as for intent, gross negligence, or personal injury).
9. Eligibility
You must be 14 or older to use Enki.
10. Changes
These terms may change as the project develops. The current version always lives here. Continued use after a change means you accept it.
